1. Agreement to Terms

By creating an account, downloading our mobile applications from Google Play or the Apple App Store, or accessing any part of the Services, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to all of these Terms, do not access or use our Services.

2. Eligibility & Account Security

You must be at least 13 years of age (or the minimum legal age of digital consent in your country of residence) to create an account. If a user is under the age of 18, their parent or legal guardian must review and agree to these Terms on their behalf.

You are responsible for safeguarding your login credentials and are solely responsible for all activities that occur under your account. You agree to notify Project Roam immediately at support@projectroamhq.com if you suspect any unauthorized access or security compromise.

• In Imminent Danger: If you, your family members, or any individual are in immediate physical danger, medical crisis, or experiencing an ongoing crime, always immediately dial 911 (or your local emergency response number).
• No Guarantee of Emergency Response: The in-app "Emergency SOS" feature sends high-priority notifications and GPS coordinates to your designated circle contacts and guardians. It does not automatically dispatch police, fire, or ambulance personnel unless paired with an optional third-party certified monitoring service explicitly contracted by you.
• Connectivity Requirements: Features such as real-time safe routing, live location broadcasting, SOS alerts, and the dead-man offline sweeper require active cellular data, GPS connectivity, and device power. Project Roam is not liable for delayed or dropped alerts caused by carrier outages, tunnel dead zones, battery depletion, or hardware malfunctions.

4. Location-Based Services & Peer Permissions

Project Roam operates through explicit user consent. By enabling location permissions on your mobile device, you acknowledge and agree that:

• Continuous background location is monitored to generate proactive routing around high-crime sectors, calculate dynamic Worry Scores, and support safety check-ins.
• Granular Peer Control: You maintain unilateral control over who can view your location and anti-stalker diagnostic findings. Location is only shared with users you explicitly invite or approve within your Family Circles.
• You may revoke location sharing or remove members from your circle at any time directly in the app.

5. Anti-Stalking & Acceptable Use Policy

Project Roam was created to protect individuals from covert tracking, domestic violence, and unwanted surveillance. We enforce a zero-tolerance policy against malicious or non-consensual surveillance.

You agree NOT to:

• Use Project Roam to track, stalk, harass, intimidate, or monitor any person without their explicit knowledge and affirmative consent (except minor children for whom you are the legal parent or guardian).
• Attempt to reverse-engineer, decompile, extract source code, or compromise the security infrastructure of our applications or routing APIs.
• Submit false, fraudulent, or malicious crime reports, emergency SOS alerts, or risk feedback.
• Interfere with or disrupt the integrity or performance of the Services, servers, or networks.

Violation of these rules will result in immediate and permanent account termination, and where appropriate, referral to law enforcement authorities.

6. Subscriptions, In-App Billing & Cancellations

Project Roam offers both free core functionality (basic safe navigation and location sharing) and optional paid auto-renewing subscriptions (e.g., Premium Family Tier with advanced Anti-Stalker heuristics, extended history, and automated safety sweeps).

• App Store Billing: In-app subscriptions are processed through Google Play In-App Billing or Apple In-App Purchase. Your account will be charged according to the terms presented at the time of purchase.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless canceled at least 24 hours before the end of the current period.
• Managing Subscriptions: You can manage or cancel your subscription at any time in your Google Play Store or Apple App Store account settings.
• Refunds: Refund requests are governed by Google Play's and Apple's respective refund policies.

7. User Content & Feedback

When you submit feedback, incident observations, or hazard reports ("User Content"), you grant Project Roam a non-exclusive, worldwide, royalty-free license to use, aggregate, and incorporate this information to improve our safety algorithms, threat databases, and routing models.

8. Third-Party Data & Safe Routing Calculations

Our safe-routing algorithms rely on diverse public and third-party data feeds, including OpenStreetMap, municipal open-data crime portals, police dispatch records, and NOAA severe weather bulletins. While we strive to maintain the most up-to-date and accurate threat models possible:

• Crime data feeds vary by municipality and may have reporting latencies.
• Road closures, active police scenes, and dynamic traffic incidents may evolve faster than public data feeds update.
• Driver Responsibility: You remain solely responsible for operating your vehicle safely, obeying all traffic laws, and exercising sound personal judgment. Never interact with the mobile app while driving.

9. Intellectual Property Rights

The Project Roam name, logo, proprietary Worry Score algorithms, software architectures, user interface designs, and visual assets are the exclusive intellectual property of Project Roam Inc. and are protected by United States and international copyright, trademark, and trade secret laws.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED ERROR-FREE OPERATION.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROJECT ROAM INC., ITS FOUNDERS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICES.

12. Indemnification

You agree to defend, indemnify, and hold harmless Project Roam Inc. and its officers, directors, employees, and agents against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms or misuse of the Services.

13. Termination & Account Deletion

You may terminate your account at any time via the in-app Settings menu or through our Account Deletion Portal. Project Roam reserves the right to suspend or terminate accounts that violate these Terms or present a security threat to other users.

14. Dispute Resolution & Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA), rather than in court. You agree to waive any right to bring or participate in a class action lawsuit or class-wide arbitration.

15. Governing Law & Jurisdiction

These Terms and any dispute related thereto shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
